5. Our lawful bases for processing
We will only process personal information where we have a lawful basis for doing so. Depending upon the circumstances, this may include:
- Performance of a contract, where processing is necessary to provide a service you have instructed us to undertake, or to take steps at your request before entering into a contract.
- Legitimate interests, where processing is reasonably necessary for the operation and development of our business, responding to enquiries, managing our services, protecting our systems or providing effective customer service, provided those interests are not overridden by your rights.
- Legal or regulatory obligations, where we need to retain or process information to comply with applicable law or professional/regulatory requirements.
- Consent, where consent is required, particularly in relation to certain forms of electronic marketing.
These bases broadly continue the approach contained within our existing privacy notice.
6. Referring enquiries to another RICS regulated surveying practice
Dunham Hale receives enquiries for surveying and valuation services across the UK. During particularly busy periods, where we do not have suitable availability, or where another surveying practice is better placed to provide the requested service in your area, we may offer to refer your enquiry to another reputable RICS regulated surveying practice.
Where we do so, we may provide that practice with information reasonably necessary for them to respond to your enquiry, which may include:
- your name;
- telephone number;
- email address;
- property address;
- the type of survey, valuation or inspection required; and
- relevant information you have provided about your enquiry.
We will only share information that is reasonably necessary for this purpose.
Where your enquiry is referred to another surveying practice, that practice is an independent business and will be responsible for its own professional services and its own processing of your personal information. You should therefore also refer to that firm's privacy information where applicable.
We do not sell your personal information to unrelated third parties for marketing purposes.
Referral of an enquiry for the purpose of helping you obtain the surveying service you have requested is separate from sharing information for third-party marketing purposes.
7. Other organisations we may share information with
Where reasonably necessary, we may also share personal information with:
- IT, website, CRM and communications providers;
- payment processing providers;
- professional advisers, including accountants, lawyers and insurers;
- contractors and service providers assisting us in providing our services;
- RICS and other professional or regulatory bodies where appropriate;
- HM Revenue & Customs and other public authorities where legally required;
- fraud prevention, security and compliance providers; and
- prospective purchasers or advisers in connection with a legitimate sale, restructuring or transfer of our business.
We require organisations processing personal information on our behalf to handle that information securely and in accordance with applicable data protection requirements.
8. Marketing
We may contact you about Dunham Hale services where permitted by law.
Where consent is required, we will obtain it before sending marketing communications.
You can ask us to stop sending marketing communications at any time by using an unsubscribe facility provided in the communication or contacting us.
We will not provide your personal information to another company for that company's unrelated marketing purposes without the appropriate permission. This is consistent with the existing Dunham Hale policy, which states that express opt-in consent will be obtained before personal information is shared outside Dunham Hale for third-party marketing purposes.

11. Data security
We take appropriate organisational and technical measures to protect personal information against accidental loss, unauthorised access, alteration, disclosure or misuse.
Access to personal information is restricted to people and organisations that have a legitimate business need to access it.
Where we use third-party service providers, we expect them to apply appropriate security and confidentiality measures.
12. How long we keep your information
We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, including satisfying legal, regulatory, professional, accounting and reporting requirements. Different categories of information may therefore be retained for different periods.
When determining an appropriate retention period, we consider the nature and sensitivity of the information, why it is required, applicable legal and professional requirements and the potential risks associated with retaining it.
Where appropriate, information may subsequently be securely deleted or anonymised.
