2. Information on this website

The information provided on this website is intended to give general information about Dunham Hale, our services and property-related matters.

We take reasonable care to ensure that information is accurate and up to date. However, property, surveying and valuation matters are highly dependent upon the circumstances of an individual property.

Information provided on this website should therefore not be treated as property-specific surveying, valuation, structural, legal, financial or other professional advice.

You should obtain appropriate professional advice before making decisions concerning a particular property.

3. Surveying and valuation services

Information on this website about services such as RICS Level 2 Home Surveys, RICS Level 3 Building Surveys, residential valuations, drone roof surveys, subsidence and structural movement inspections, auction and pre-auction inspections, and other surveying services is intended to provide a general description of those services.

The precise scope of an inspection or professional service will depend upon the service instructed, the property, accessibility, safety considerations and the specific terms agreed with the surveying practice undertaking the instruction.

Website descriptions do not override the formal Terms of Engagement, Terms of Business, Scope of Inspection or other contractual documentation issued in connection with an instruction.

4. Quotations

You may use this website to request a quotation for surveying, valuation or related services.

Submitting a quotation request does not create a contract between you and Dunham Hale or any surveying practice within our network.

Any quotation may be subject to confirmation following consideration of matters such as:

  • property type;
  • age;
  • size;
  • location;
  • construction;
  • condition;
  • complexity;
  • accessibility;
  • service required; and
  • other relevant circumstances.

A contract for professional services will only arise once the applicable instruction process and Terms of Engagement have been completed or otherwise agreed.

5. Availability of surveyors

Surveyor availability varies according to location, workload, property type and the service required.

Submitting an enquiry through this website does not guarantee that Dunham Hale will be able to undertake the requested inspection within a particular timeframe.

Any inspection date or report-delivery timeframe will be subject to confirmation.

6. Referrals to other RICS regulated surveying practices

Dunham Hale works with and may refer enquiries to other reputable surveying practices.

During busy periods, where we do not have suitable availability, where a property falls outside the availability of our directly available surveyors, or where another surveying practice is better placed to undertake the work, we may offer to refer your enquiry to another RICS regulated surveying practice.

Where an enquiry is referred, the surveying practice undertaking the instruction may be a separate and independent business.

Where this applies, that practice will be responsible for its own professional services, professional indemnity insurance, Terms of Engagement, professional obligations and the survey or valuation it undertakes.

You should check the identity of the surveying practice named in your quotation, instruction documents or Terms of Engagement before proceeding.

Information about how personal information may be shared when making a referral is provided in our Privacy Policy.

7. RICS regulation

Where we describe Dunham Hale or another surveying practice as RICS regulated, this refers to the relevant firm's regulatory status.

Individual surveyors may also hold RICS professional qualifications or membership appropriate to their role.

The professional status and regulatory details applicable to a particular instruction should be confirmed within the relevant engagement documentation where appropriate.

8. Drone inspections

Where a service includes, or may include, the use of a drone, a drone flight cannot be guaranteed.

Drone operations are subject to circumstances including:

  • weather;
  • wind;
  • visibility;
  • property location;
  • airspace restrictions;
  • safety considerations;
  • privacy considerations;
  • site conditions;
  • regulatory requirements; and
  • the professional judgement of the operator.

Where a drone cannot safely or lawfully be operated, alternative inspection methods may be used where appropriate and the resulting limitations will be considered in accordance with the scope of the instructed service.

9. Repair costs and other estimates

Where a surveying service includes indicative repair cost information, any figures provided are intended to assist the client in understanding the possible scale of expenditure.

Actual costs can vary according to specification, location, contractor availability, access, market conditions and the extent of work identified once repairs commence.

Unless expressly agreed otherwise, indicative repair costs are not contractor quotations, tenders or guarantees of the price at which work can be completed.

10. Valuation information

General information about property values contained on this website does not constitute a professional valuation of any particular property.

A professional valuation requires an appropriate instruction and consideration of the relevant property, purpose, valuation date and available evidence.

Market conditions can change and no statement on this website should be interpreted as a guarantee of the present or future value or sale price of a property.

11. Property defects and examples

Photographs, illustrations and descriptions of property defects used on this website are provided for general educational and illustrative purposes.

A defect shown on one property does not necessarily have the same cause, significance or remedy as a visually similar defect affecting another property.

For example, cracking may result from numerous causes and should not be assumed to represent subsidence solely because it resembles an image displayed on this website.

A property-specific professional assessment may be required.

12. Reports and professional advice

A survey or valuation report is prepared for the client identified in the relevant instruction and for the purpose stated in the applicable Terms of Engagement.

Unless expressly agreed otherwise, third parties should not rely upon a report prepared for another person.

Any permitted reliance, distribution or reproduction of professional reports will be governed by the relevant Terms of Engagement rather than these website terms.

13. Intellectual property

Unless otherwise stated, the content of this website, including its written content, branding, logos, graphics, photographs, illustrations, page designs, reports and examples, and other original material is owned by, licensed to, or used with permission by Dunham Hale.

You may view and print reasonable extracts for your personal, non-commercial use.

You must not reproduce, republish, commercially exploit, scrape, systematically extract or distribute substantial parts of this website without prior permission, except where permitted by law.

Third-party trademarks and content remain the property of their respective owners.

14. Website availability

We aim to keep the website available and functioning correctly, but we cannot guarantee uninterrupted access.

We may suspend, withdraw, modify or restrict parts of the website where reasonably necessary for maintenance, security, updates or other operational reasons.

We are not responsible for interruptions caused by circumstances outside our reasonable control.

15. Links to other websites

This website may contain links to third-party websites and services.

These links are provided for convenience and information. Unless expressly stated otherwise, a link does not mean that Dunham Hale endorses or controls the third-party website.

We are not responsible for the content, availability, security or privacy practices of third-party websites.

16. Acceptable use

You must not knowingly use this website:

  • unlawfully or fraudulently;
  • to introduce viruses, malware or other harmful material;
  • to interfere with the operation or security of the website;
  • to attempt unauthorised access to our systems;
  • to submit deliberately false or misleading enquiries;
  • to harvest personal information;
  • to send unsolicited or abusive communications; or
  • in a way that could damage Dunham Hale, our systems or other website users.

17. Liability for website information

Nothing in these terms excludes or limits liability where it would be unlawful to do so.

Subject to applicable law, Dunham Hale will not be responsible for loss arising solely from reliance upon general information provided on this website where property-specific professional advice should reasonably have been obtained.

Our liability in relation to an instructed professional surveying or valuation service is governed by the Terms of Engagement applicable to that instruction, rather than these general Website Terms of Use.

18. Privacy and cookies

Our collection and use of personal information is explained in our Privacy Policy.

Our use of cookies and similar technologies is explained in our Cookie Policy.

By using the website, you should also review those documents.

19. Accessibility

We aim to make the Dunham Hale website accessible to as many users as reasonably possible.

Further information is available in our Accessibility Statement.

20. Changes to these terms

We may update these Website Terms of Use from time to time, including where our services, website functionality or applicable requirements change.

The latest version will be published on this website together with the date it was last updated.

21. Governing law

These Website Terms of Use are governed by the laws of England and Wales.

Any dispute relating to the use of this website will be subject to the jurisdiction of the courts of England and Wales, subject to any rights that consumers may have under applicable law.
